Man admits assault in Huby

A man was left bruised and with a chipped tooth after an assault in Huby.

Martin Lister, of St Margaret’s Road in Knaresborough, pleaded guilty to one count of assault by beating at Harrogate Magistrates Court yesterday (October 30).

Kaye Barnard, prosecuting, told the court the named victim was previously in a relationship with a woman, but it ended on August 2 this year.

The following day, Lister accompanied the woman to the victim’s property in Huby to collect her belongings.

However, the court heard when the victim opened the door, Lister “barged” into the house, pushed the victim into a bathroom and assaulted him.

Lister then pushed the man into a corner and punched him in the face, Ms Barnard said.

Neighbours heard the commotion but, after the victim gave the woman her belongings, Lister left.

The victim has issues with his health and requires care, so he was not able to defend himself during the assault, the court heard.

Ms Barnard added:

The complainant went to hospital… he sustained a 10cm bruise on his back and his ribs were tender to the touch.

His left, rear-side molar was also badly chipped.

Ms Barnard also said the Crown believes Lister, 60, used “substantial force” against the victim.

Andrew Tinning, defending, requested the case be adjourned for a pre-sentence report.

The magistrates accepted the request and ordered a pre-sentence report be prepared.

Lister will return to Harrogate Magistrates Court for sentence on January 30 next year.
