Investigation: Harrogate targeted for development during planning chaos

An investigation by the Stray Ferret has uncovered how some of Britain’s biggest land promoters deliberately targeted Harrogate to exploit cheap land and high property prices.

Between 2014 and 2020 the district’s planning system was in disarray.

These failings made it easy for developers to get controversial housing schemes approved. The developers, knowing this, made speculative applications for thousands of homes across the district.

All this week, the Stray Ferret looks at the impact of six years of planning failings: thousands of extra cars on the roads, large detached houses prioritised over much-needed affordable homes for local people, and a lack of sustainable, environmentally friendly building.

Today, we examine how the Harrogate district became a target for opportunistic developers .

The draw of Harrogate

The Harrogate district is a prime place for money to be made in property.

It’s one of the most desirable places to live, often coming top in national property surveys. Just last month, Harrogate was named the ‘chic capital of the North’ by Tatler. It makes it very attractive to developers.

The latest figures put the average home at almost £360,000 – a whopping 13 times the average income for the district.

It is, according to the Harrogate Borough Council Housing Strategy 2019-2024, the least affordable area in the north of England.

It means home owning is out of reach for many low to middle income families caught in the Harrogate housing trap. There are more than 2,000 families in the district on the Housing Register living in unsuitable accommodation.

It’s not a question of Harrogate building too many properties. Rather, it’s too few of the right homes, in the right places, at the right price to meet local people’s need for affordable homes.

Planning failings

Every council has to put forward a 21-year plan to the Secretary of State for approval.The Planning Inspectorate examines local plans on the Secretary of State’s behalf to determine their suitability.

In 2014, the Planning Inspectorate advised Harrogate Borough Council  to withdraw its version of the Local Development Plan (or LDP 2014-2035).

The LDP sets out the council’s priorities and policies for land use. It defines where and how many homes can be built, where employment sites are located and what our town centre will become.

For a plan to be approved, it must demonstrate that it is well evidenced and meets local need. The plan must be in accordance with the National Planning Policy Framework and a raft of legislation, practice guidance and regulations.

Harrogate Borough Council withdrew its draft LDP at its first hearing on April 24, 2014, upon advice from the planning inspectorate.

The failed plan – years in the making – was deemed ‘inadequate’.

A letter from the Planning Inspectorate to Harrogate on April 29, 2014 explained that the evidence used in the plan was too out of date to be meaningful.

Harrogate was forced back to the drawing board.

Prior to its submission, Liberal Democrat leader councillor Pat Marsh had told the Yorkshire Post:

“I do not have confidence in anything to do with the plan, whether it be the actual allocation of homes, whether there is the necessary infrastructure in place to cope and how members will be able to decide on the final proposals which are still being finalised. I have been a councillor for 22 years, but I have never experienced anything quite like this. It is a complete shambles.”

Conservative councillor Alan Skidmore, who was appointed cabinet member for planning at HBC in 2012, publicly defended the plan at the time. Yet speaking to the Stray Ferret this year, he said he knew the plan that had been prepared was “absolute rubbish”.

“I was astonished. I delayed it as much as I could, much to the chagrin of certain planning officers. We were forced to submit it in the state it was in, because if we didn’t, the government would have taken steps against us.”

Land supply

Harrogate failed on another critical requirement. Councils must show that they have a supply of specific deliverable sites enough to provide five years’ worth of new housing (plus an appropriate buffer).

This is called the five-year land supply (5YLS).

In 2014, the council had more than two thousand families on the housing register.

Planning inspectors and developers surgically dissected Harrogate’s calculation that just 390 new market and affordable homes per annum was enough to meet housing need.

The figure had to be revised, and Harrogate employed a consultant, GL Hearn.

To meet the 5YLS, Harrogate had to find enough developers with land to deliver 1,050 completed homes a year.

As a result, the land earmarked for development within the plan was insufficient.

The perfect storm

Without an approved local plan and evidence of a five-year land supply, a condition called the ‘tilted balance in favour of presumption of approval’ was triggered which prioritised building houses.

In 2013, the Campaign for Rural England warned local government that a

“widespread failure to implement local plans left 175 local authorities (including Harrogate) vulnerable to ‘damaging development’”.

But the Federation of House Builders disagreed, saying:

‘‘Fears that the lack of a (local development) plan will lead to the untrammelled destruction of the countryside are overblown. Even where there is no Local Plan, development must still conform to the NPPF, which clearly sets out that development must be well located, well designed and sustainable.”

Harrogate Borough Council planners advised councillors from 2014 to 2018 that there was a ‘tilted balance’ in favour of approval on almost every major development regardless of whether the site was well located and sustainable.

For almost every major housing scheme, planning officers advised committee members to approve the application.

The planning committee did turn down some applications during that time, though, and the council successfully defended its decision at appeal.

A district vulnerable to promoters

Enter the land promoter: land promoters seek out land which could be ripe for housing and help the owner get outline planning permission before managing the onward sale to a developer.

In the Harrogate district, a hectare of agricultural land will fetch around £25,000 at the farmers’ auction.

As a development site with outline planning approval, the same land will realise between £1.2 and £2.3 million.

The promoter then takes a share of the land’s increased value when it’s sold.

Gladman Land is the promoter behind applications for nearly 1,500 properties in the district since 2014, including Harrogate, Boroughbridge, Killinghall and Knaresborough.

Co-founder David Gladman told the High Court in July 2016:

“We normally only target local authorities whose planning is in relative disarray and… either have no up-to-date local plan or, temporarily, they do not have a five-year supply of consented building plots.”

Even if the council refuses the application, it’s of no consequence.

Gladman Land stated that going to appeal was part of its business strategy, with a success rate of over 90%. They advertise themselves as one of the most successful land promoters in England.

It’s completely legal and was essentially a standard practice within the land promotion industry.

In 2016/17, Harrogate received the highest number of planning applications since records began.

Strengthening position

By January 2019, Harrogate could demonstrate a robust 5YLS which tilted the balance in a different direction.

Harrogate Borough Council’s planning committee was advised to support an outline application by Gladman’s to build 175 houses on Bar Lane, Knaresborough.

The debate ran over several hours with councillors struggling to reach a consensus, despite officers’ recommendation to approve the proposal. Eventually, the committee deferred the application to planning officers to approve, subject to some details being finalised.

But just nine months later, on September 9, 2019, the same application returned to the planning committee who refused it against the advice of officers.

The advanced state of the local plan and a healthy 5YLS gave the planning committee the confidence to reject the proposal.

The local development plan was finally accepted by the planning inspectorate and adopted by HBC in May 2020 affording further protection against harmful development in the borough.

But the damage has been done to the fabric of our communities, and over the next week, the Stray Ferret will look at the impact that six years of planning dysfunction has had on the lives of local people.

The Stray Garden: Planting tulips for spring colour pops

The Stray Garden is written by Rudding Park‘s Kitchen Gardener, Fiona Slight.

Fiona has worked in horticulture for over 30 years in the UK and abroad, and specialises in growing fruit and vegetables for fine dining. 

 

 

If the winter days and this current strange situation is starting to get you down, it’s the perfect time of year to plant some bulbs. Tulips, in particular are perfect to plant now, and will fill you with the anticipation of the wonderful colour to come in the spring to help cheer you up.

There are hundreds of cultivars to choose from, and these are divided up into 15 different groups which include Lily flowered group, Triumph group, Fringed group, Parrot group and Darwin hybrid group. At Rudding Park, we tend to use a mixture of these in containers to produce a wonderful mixture of colours and textures.

Tulips are perfect for containers and indeed most bedding types flower at their best the first year they are planted. The varieties we are using this year are: ‘Paul Scherer’, ‘Slawa’, ‘Queen of the Night’, ‘Recreado’, ‘Princess Irene’ and ‘Purple Prince’. A mixture of orange and purple shades that really pull a punch when they are in full flower.

We use large, deep pots for our displays, planting the bulbs in layers between 20cm and 8 cm deep. The deeper you plant the better the flower, this is especially important when you plant in the ground. You can plant the bulbs closer together in containers as the bulbs will not be staying there permanently and it does add to the overall impact. Just make sure they are at least a ‘fingers width’ apart to avoid them touching and the possibility of passing on a fungal disease.

Any well-drained multipurpose compost will work well, but make sure you add drainage to the base such as crocks or gravel. This will ensure the bulbs don’t sit in water and potentially rot off. 

After that, it’s simply a case of finding a sheltered, sunny position to locate your pot. Of course, you could store the pot until you are ready to place it into its final position or you could just place it where you want it to flower and enjoy watching them develop over the winter and early spring. Don’t forget to check the pots for water as they can dry out very easily, especially if we get a dry spring.

Top tip: it is possible to re-plant the bulbs once they have finished flowering, but make sure you dead head the flower as soon as it has finished flowering and re-plant it in its new position straight away. Don’t forget grit for drainage if needed and a little general fertiliser in the planting hole just to get them going.  Word of warning, some cultivars will re-flower better than others!

So, to tempt you to get out there and plant those bulbs, I thought I would finish with a few ‘throwback’ images to April this year. The Rudding Park tulips came into full flower just as lockdown began, so whilst it was a shame our guests didn’t get to see the array of colour bursts, it was reassuring and joyful to see there was no stopping Mother Nature. Stray Foodie: a hint of Festive flavours

As we are beginning to get a little Christmasey here at Paradise takeaway (for the moment!) to cheer ourselves up during these quiet November days, the seasonal and warming flavours of this dish produce an excitement on the palate and makes us think of all the good things to come!

This week’s recipe is Chestnut, Yellow Beetroot, Clementine and Sticky Ham.

A large glass of Ginger Wine enhances the earthy, healthy flavours making once more a very versatile dish that can be extended or made more delicate, as required.

For the ingredients, per portion, you will require:

Chestnut, Yellow Beetroot, Watercress, Clementine and Sticky Ham

Method:

Roast the Beetroot at 200c for 30 mins with a little oil, garlic and mixed herbs.

After 15 mins add nipped Chestnuts (with the skins cut to stop them exploding!)

Cook for a further 15 mins and remove the beetroot and chestnuts from the oven.

Peel the clementine and remove pith and segment.

Cut the fresh ginger into thin strips.

Slice the bacon into 1cm thick strips.

Put the orange juice, maple and shallot in a pan and bring to the boil.

Add bacon and ginger.

Cook until nicely caramelised, approx. 15 mins.

Add the beetroot and chestnuts.

Arrange on a plate with lots of dressed watercress and the Tapenade.

A dollop of Sour Cream or Yoghurt adds a touch of luxury.

A Recipe for the dressing:

Mix together.  This will make a great dressing for the watercress and will stand you in good stead kept in the fridge for future use.

Once again, adding fresh herb such as rosemary, coriander and basil will always enhance further.

Property Gold: Virtual Tours – are they worth it?

This week Alex explains the benefits and pitfalls of selling your home using virtual tours. 

When it comes to selling your home, we are consistently told that estate agents need to use every tool at their disposal – from accompanied viewings to drone imagery and social media campaigns. However one relatively new bit of technology is getting a lot of coverage both by agents and indeed the property portals – virtual tours.

From the comfort of your armchair, you can now have a ‘virtual look’ around a property in high resolution and never leave your own home. Given the Covid circumstances we currently find ourselves in, there is a strong argument to create a virtual tour of your home. Afterall they look great, buyers seem to love them and if it helps sell your home then why not?

However as I see it, there is another angle to virtual tours and the way they are generally used in the marketplace currently is questionable.

Firstly and most importantly, a virtual tour is a significant security risk. Having interviewed a former Royal Marine Commando who now runs his own security business, he concurred that given the high resolution of these tours and ability to zoom-in, meant he could easily find out where alarm panels and sensors were, family photographs and documents to research the vendor, where keys were kept, high value items, plus of course take an in-depth walk through. Thankfully he was one of the good guys, but what if he wasn’t?

The other issue is that virtual tours are often casually placed online, however it gives too much information away up front about a property. You are letting interested parties make up their own minds about your home, without them engaging with the agent, which somewhat defeats the object of the exercise, especially if they have got the wrong impression.

It is always encouraging to hear that you received several hundred views of your virtual tour, however the agent can’t follow any of these viewers up, as they and the portals do not know who actually viewed it.

Instead, I feel the key with virtual tours is to keep them offline and for the agent to retain control by offering ‘accompanied virtual tours’. This means that an interested party can still virtually look around your home, however the agent shares their computer screen and talks the viewer through in real time. This means you will get better feedback, more engagement and don’t unnecessarily add to your digital footprint.

Setting out to write for the Stray Ferret – which I am delighted to see is going from strength to strength – I had in mind that my articles would look first at Art in the landscape in its last flush of autumn and then look at Art inside. I had not appreciated that we would all follow these instructions so assiduously!

Our home may be where our heart is, and it is also a place that is playing an increasingly important role in our lives, acting as the location of not just living, but work, and often indeed of socialising, which is done increasingly on-line nowadays. There is even a subgenre of interior design specialising in the perfect backdrop for your online video calls. But is your collection just for show for others to see, and if not does it really matter how it is presented? The answer is yes and no to both questions.

If you are thinking of collecting it is easier to say what you are not doing than what you are. For example, I am not interested in only buying ceramic works by British designers from 1950-1965, or I am only buying in the price range of £x, or I am only interested in furniture with mouse carvings on them.  Some of the greatest collections have been inspired by very simple principles and not always with big budgets. Most collections I have visited or taken part in designing have always had to concede to the object and give objects primacy in the visual narrative.

But how do we live with Art? I hope you will go along with me if I suggest that Art is not just the object but also the process of how it is made – and that process gives an object its beauty. I am not an interior designer but what I do look at – and very good interior designers do this too – is the materials and the craftsmanship of an object. So in that sense a contrast can work really well. For example, well made vintage furniture – Heals mid 20th Century – with craftsmanship and good design – can set off something really expressive and even unruly. Contrasting materials is really satisfying as well, and Glass is a material at the heart of European art history and yet all too rare in this country.

Well placed objects can be an inspiration on a daily basis as we pass them or stare at them over the top of a desk top. They are portals to the world of their creative makers, to memories of when they entered your life and assets to enjoy. So think about them as characters and imagine who or what they would like to share space with and you have probably latched onto your next thing. Remember matching is pleasing but contrast is interesting.

When we come off lockdown on 2 December and you wish to look at beautiful and beautifully made objects and see how they are displayed, I recommend visits to Temple Newsam in Leeds and the Bowes Museum in Barnard Castle – each offering important collections of European fine and decorative arts in room settings – real treasure houses in a county so rich in country houses.

This week’s recipe is Wild Mushroom, Coconut Rice, Celeriac, Kale, Turmeric & Humous.

Designed to be a starter, vegetarian main course or a side dish, the quantities are for 1.

For a special occasion I recommend it being partnered with a fabulous quality sparking wine, such as Brut Dunesford Pinot Gris 2018; made just outside of York, it has a refined dryness, is slightly sweet on the palate and well balanced. With the turmeric in this dish, it makes a huge sensation in the mouth. How exciting it is to be able to produce local food partnered with local wine? It is rare and quite special.

The ingredients for this dish

For the recipe I have taken:

The finished dish

Method:

Peel the Celeriac and with a medium size cutter cut out 4 discs.

Poach in a little water (or stock or your choice), butter, salt and pepper until cooked.

Sauté off the mixed mushrooms in a little oil, salt and pepper.

Finely chop the green chilli, taking care to remove the seeds.

Stir the chilli in to the rice with the coconut milk, grated ginger and a sprinkling of chopped herbs.

Mix the grated turmeric in the white balsamic.

Pour the lime juice over the kale.

Build the celeriac, rice and mushrooms on a plate, finishing with the humous and placing the turmeric on top.

Garnish with the remaining ingredients.

This is delicious and can also be prepared in advance which always helps a busy cook!

Laura’s Law: Is your ex weaponising your children?

Laura’s Law is a monthly legal column, written by family lawyer, Laura Mounsey. Laura is a partner at Harrogate Family Law. She specialises in dealing with divorced couples and people who have been in abusive relationships. Her role involves protecting her clients’ assets and income if they want to live with someone or get married and resolving disagreements about children.

This week Laura advises on what to do if your ex is weaponising your children.

 

If you are in the process of separating (or thinking about doing so), you may be terrified about losing your children. You may be worried that your ex will be so intent on ‘revenge’, that they will try to weaponise your children against you.

Typically, by the time that people ask for my help, they tell me that their:

  1. Children’s opinion of them has become very negative
  2. Children are acting out against them and rejecting them
  3. Ex keeps taking their children away from them
  4. Ex has made all sorts of allegations about them as a parent

It isn’t uncommon for children to struggle with their parents’ separation. However, sometimes your ex may throw your children into the middle of a conflict by manipulating their view of you and burdening them by having to ‘choose a side’. Being bombarded with such responsibility and pressure can cause them significant distress.

It is not fair for your ex to try to damage your children’s relationship with you. However, it can and does happen. It’s likely to get worse the longer you leave it. Sadly, I have seen an increase in this behaviour during the pandemic lockdown. Particularly where children have been withheld from seeing one of their parents.

Often, if you approach your ex on your own and challenge them about the way that they are treating your children, they will deny it. This often backfires and allows your ex to spin your concerns against you, as if you are in the wrong. This can leave you feeling trapped without a way out.

Does this sound familiar?

When you separate, your children need you both more than ever and that should be a priority. However, your ex may see your children as a way to get what they want, regardless of what damage they may cause getting there.

It isn’t impossible to deal with your ex’s behaviour however it is time critical because the more you delay, the more damage may be done. To disarm your ex, for your children’s sake as well as your own, it is vital that you reach out.

You should also consider:

  1. Telling your ex in writing about your concerns and set out why
  2. Keeping a log of what has been happening
  3. Asking for professional support for you and/or the children

This is particularly important, now that we are in another lockdown. Even though we cannot meet in person for now, you can still reach out and get help. The court is also still open, so you are not alone.

Usually my role at the Stray Ferret is to bring you a monthly review of a local restaurant or café. With the news that restaurants have once again been forced to close, these usual monthly reviews have been put on the back burner.

That doesn’t mean we can’t still support local restaurants. Like so many others in the area, my own business, Paradise Foods, is continuing to provide takeaway food – just come along, see what you would like to eat, and take home that special dish. This week’s recipe is Broccoli, Cashew, Parsnip, Maple, Mixed Kales and Crouton.

This dish works well on its own or as a great accompaniment to smoked haddock in a pesto cream, hot smoked salmon or parma ham – or even a lime-based cocktail!

For 1 generous portion you will need:

I also used the last of the season’s Nasturtium seeds, flowers and leaf. These can be substituted with coriander, basil or mint flowers for flavour.

Method:

Place the olive oil in a pan with the parsnips and cook for 2 minutes.

Add the Cashews for 1 ½ minutes.

Add the Broccoli and Kale, Herb Pesto and stir well.

Season with salt and pepper to taste and add the Maple Syrup.

Garnish with the Mixed Herbs, Spring Onion and Croutons.

If you would like to be a little adventurous with the croutons, you can always add Marmite, cream cheese and a squeeze of Lime for that umami taste!

Stray Foodie: The Wild Plum, Harrogate

Frances’ Lunch: Crazy A-Bao You for £13.50 and a cup of coffee for £3.25

Looking up at the pink neon ‘Wild’ sign I thought to myself, am I in the Hardrock Café or is this a dream?

I was in fact in a restaurant located above a very popular ladies’ couture venue, The Snooty Frox, in Harrogate.

The Wild Plum Café is busy, modern, clean and bright and I’ve been told customers queue to enter such a hallowed space. It certainly is the place to be; it’s a vibrant and trendy space. A great contrast to the entrance, where I was met by the Lady of the House who was most charming. I was shown upstairs and found Girl Power at its best.

They were dishing out bags of style from an open kitchen with fabulous bottles of fermented fruit and vegetables. This immediately says, ‘serious kitchen’.

This is clever food; artistic, creative and hot (in every sense of the word). The Menu included the sort of food you can eat at any time of the day, assuming the seasoning is taken care of.

I was spoilt for choice but had the home-made Crazy A-Bao You with Carrot Kimchi, Sesame Soy Crispy Egg and Sriracha Mayo with the Crispy Cornflake Chicken. It arrived as Bao Buns – which were as pink as the Neon sign – in a bamboo steamer.

The Carrot Kimchi was on its base with Cornflake Chicken-style burgers and Crispy Eggs topped with a wonderful array of culinary flora. It had a syringe of Mayo at its side and some sweet jam. This was a very generous portion.

There were plenty of other choices and I was very tempted to have the Butternut Squash Fritter (GF) which was Mexican-style with smashed avocado, poached egg, rocket, sweet chilli jam, roasted garlic yoghurt and homemade salsa.

The Wild Plum Buddha Bowl sounded so exciting but with so much going on. Maybe – for a slightly reserved palate – a little confusing?

This food was exciting, tasty and young and I was told everything is made fresh on the premises. Looking around the Café, the other dishes were colourful and lovely.

Knowledge of flavour and ingredients comes with experience and perhaps not always so exciting but leaves a longer lasting impression.

These are exciting times in the culinary world, as it is all changing. It is young dedicated female chefs, like Bethany, who will shortly be leading the way in our industry, certainly in Harrogate.

StrayArt with Johnny Messum: The significance of bronze

StrayArt is a monthly column written by Johnny Messum, Director and Founder of art gallery and centre, Messum’s Wiltshire, London and Harrogate.  Johnny’s passion is for contemporary art and sculpture.

It is a challenge to feel clear about the immediate future. We have new structures to adhere to, I have visors supplied for my team in the car, along with the NHS track and trace QR code to go in the window.

What should have been alongside me instead, was the formidable British sculptor, Bridget McCrum, whose family, the Bains, hail from Leeds. Now in her late eighties she was planning to come to the opening of her show in James Street.

Along the way I had imagined us discussing sculpture in the landscape, something that is taking on added dimensions, not least because it is one of the few places where we can safely view art without PPE, but also because it is, in itself, interesting and complex.

Amongst the myriad attractions of Yorkshire, the landscape has to rank amongst the highest. It is a daunting partner to duet with as a sculptor. There is nowhere this subject is more comprehensively demonstrated than at the Yorkshire Sculpture Park, where I went to see the work of a friend, Sean Henry, and of an artist I am showing in London, Jorgen Haugen Sorensen.

Set into the landscape there, each work takes its cue from the ground around it. I sometimes think that of all the artists, perhaps only local boy, Henry Moore, had the swagger to meet the rolling landscape toe to toe, so to speak. His work stands resolutely chest open to the wind and wilds.

The rule of thumb in placing sculpture in the landscape is one of scale and context. Seldom best placed in wide open spaces, they often prefer the same locations humans do, close to the house, in glades between shrubs or woodland corpses. This is seen well in the locations chosen in the Himalayan Gardens and Sculpture Park in Grewelthorpe, near Ripon, which is open to the public until November 1, 2020.

Sculptures placed outside really come into their own in the autumn. They become the key focus until the verdant spring surges forward once more. It is the perfect time to head into the open air as the greenery falls away and the landscape itself becomes more architectural.

Do be careful though with the choice of materials; the weather does not spare sculptures any more than other objects, so stones need to be wrapped if it gets cold and on a hot afternoon rub beeswax into the exposed bronzes. Perhaps the artist who most willingly accepted the ravages of time is Cheshire-born artist, Andy Goldsworthy, whose work picks up and changes with the rhythms of the seasons.

Next time I shall be bringing the boat to harbour so to speak and talking about living with art in the house – combining old and new objects and thinking about ways of displaying artworks to their best advantage.
