A Harrogate man was sentenced for three offences at Harrogate Magistrates Court on Friday (January 31).
Carl Blackmore, of Spa Lane, previously pleaded guilty to one count of attempted burglary with intent to steal, one count of use of threatening or abusive words or behaviour and one count of theft from a shop.
He appeared before court for sentencing on Friday.
Mel Ibbotson, prosecuting, told the court the attempted burglary offence happened on August 19, 2023.
The court heard the owner of a Ripon restaurant says he saw man, who was "in drink", acting suspiciously around the restaurant.
Ms Ibbotson said the owner recalled the man mumbling something, but the restaurant was closed and the owner walked towards his car.
She told the court the restaurant owner then checked the CCTV and saw the same man trying to open the restaurant door and smash one of the restaurant windows.
Ms Ibbotson said:
The owner covered the broken window himself. There was no damage to the security camera, but the security light was damaged and cost £20 to replace.
The court heard the restaurant owner felt “nervous something else would happen” after the incident and suffered from emotional stress.
On September 10 last year, a member of staff at Foss Park Hospital in York was called to help with an incident at the hospital.
Ms Ibbotson said Blackmore, 36, was accusing staff members of being thieves and trying to steal his mobile phone.
She told the court:
When [named victim] told the defendant to calm down, the defendant said: ‘I know where your house is, I will kill you.'
Blackmore also stole £42.90 worth of items from the Co-op on Knaresborough Road, Harrogate, on November 1 last year.
Ms Ibbotson said the defendant stole coffee and drinks but was identified through CCTV.
Andrew Tinning, defending, told the court Blackmore was at Foss Park Hospital following a serious incident.
The court heard Blackmore maintains he struggles with his mental health and feels he would benefit from help.
Mr Tinning acknowledged the defendant has an “unenviable record”.
The magistrates sentenced Blackmore to a 12-month community order.
This includes 15 rehabilitation activity days and a six-month drug rehabilitation requirement.
Blackmore must also pay a total of £162.90 in compensation.
